Welcome to Buy & Stamp<\/strong> (\u201cwe,\u201d \u201cour,\u201d or \u201cus\u201d). These Terms & Conditions (\u201cTerms\u201d) govern your use of our platform, websites, mobile applications, and related services (collectively, the \u201cPlatform\u201d). By accessing or using Buy & Stamp, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.<\/p>\n\n\n\n

1. Overview<\/h2>\n\n\n\n

Buy & Stamp is a digital loyalty and customer engagement platform that enables businesses (\u201cMerchants\u201d) to issue digital stamp cards, gift cards, and reward programs to their customers (\u201cCustomers\u201d). We act solely as a technology facilitator, connecting Merchants and Customers through secure digital transactions.<\/p>\n\n\n\n

2. Use of the Platform<\/h2>\n\n\n\n
    \n
  • You must be at least 18 years old or have the consent of a legal guardian to use our services.<\/li>\n\n\n\n
  • You agree to use the Platform only for lawful purposes and in accordance with these Terms.<\/li>\n\n\n\n
  • You are responsible for maintaining the confidentiality of your account credentials and any activity that occurs under your account.<\/li>\n<\/ul>\n\n\n\n

    3. Relationship Between Buy & Stamp, Merchants, and Customers<\/h2>\n\n\n\n
      \n
    • Buy & Stamp is not the seller or issuer of Merchant Gift Cards or Rewards.<\/strong> All Gift Cards, Loyalty Points, and Stamps are issued, owned, and managed by individual Merchants.<\/li>\n\n\n\n
    • Buy & Stamp acts as an intermediary platform to facilitate the digital sale, distribution, and redemption of these rewards and cards.<\/li>\n\n\n\n
    • Any claims, disputes, or liabilities related to redemption, refunds, or service quality lie solely with the respective Merchant.<\/li>\n<\/ul>\n\n\n\n

      4. Gift Cards<\/h2>\n\n\n\n
        \n
      • Gift Cards are issued by participating Merchants and can only be redeemed with that Merchant.<\/li>\n\n\n\n
      • Gift Cards are inclusive of all applicable taxes as defined by the Merchant.<\/li>\n\n\n\n
      • Once purchased, Gift Cards cannot be refunded or exchanged unless under exceptional circumstances determined by Buy & Stamp in accordance with Nepali law.<\/li>\n\n\n\n
      • Refund requests are valid only within 7 days of purchase<\/strong> if the card has not been redeemed and the balance remains unused.<\/li>\n\n\n\n
      • Buy & Stamp is not responsible for lost, stolen, or unauthorized use of Gift Cards after purchase.<\/li>\n\n\n\n
      • Merchants are required to honor valid Gift Cards in accordance with their stated terms and validity periods.<\/li>\n<\/ul>\n\n\n\n

        5. Loyalty & Rewards Programs<\/h2>\n\n\n\n
          \n
        • Stamps, points, or rewards earned through participating Merchants are subject to the specific program rules defined by each Merchant.<\/li>\n\n\n\n
        • Buy & Stamp provides digital tracking and record-keeping for these programs but does not determine or control earning or redemption policies.<\/li>\n\n\n\n
        • Expired or revoked rewards cannot be reinstated once the validity period lapses.<\/li>\n<\/ul>\n\n\n\n

          6. Payments and Payouts<\/h2>\n\n\n\n
            \n
          • All customer payments for Gift Cards or rewards are processed through secure, trackable electronic channels.<\/li>\n\n\n\n
          • Buy & Stamp releases payouts to Merchants within two (2) weeks<\/strong> of successful transaction completion.<\/li>\n\n\n\n
          • After payout, all legal and financial obligations related to redemption or customer disputes rest solely with the Merchant.<\/li>\n\n\n\n
          • Buy & Stamp charges a 5% processing fee<\/strong> on transactions, which constitutes its commission for providing the facilitation service.<\/li>\n<\/ul>\n\n\n\n

            7. Data Privacy and Analytics<\/h2>\n\n\n\n
              \n
            • By using our Platform, you consent to our collection and processing of personal and transactional data in accordance with our [Privacy Policy].<\/li>\n\n\n\n
            • We may use tools such as Google Analytics, PostHog, or similar services to analyze usage patterns and improve user experience.<\/li>\n\n\n\n
            • Data may be shared with Merchants or service providers strictly for service fulfillment and analytics, never for resale or unrelated marketing purposes.<\/li>\n<\/ul>\n\n\n\n

              8. Communication<\/h2>\n\n\n\n
                \n
              • Buy & Stamp and participating Merchants may contact you via email, SMS, or WhatsApp regarding transactions, promotions, or account activity.<\/li>\n\n\n\n
              • Official notices, policy updates, or contractual communications will be shared electronically through your registered email address.<\/li>\n\n\n\n
              • You are responsible for maintaining valid contact information and updating us if it changes.<\/li>\n<\/ul>\n\n\n\n

                9. Business Closure or Service Discontinuation<\/h2>\n\n\n\n
                  \n
                • In the event a Merchant ceases operations after payout has been made, Buy & Stamp bears no financial responsibility for unused or unredeemed Gift Cards.<\/li>\n\n\n\n
                • We may assist Customers in dispute resolution on a best-effort basis but cannot guarantee compensation or redemption.<\/li>\n<\/ul>\n\n\n\n

                  10. Prohibited Use<\/h2>\n\n\n\n

                  You agree not to:<\/p>\n\n\n\n

                    \n
                  • Misuse, hack, or interfere with the operation of the Platform.<\/li>\n\n\n\n
                  • Attempt to exploit or manipulate loyalty or reward systems.<\/li>\n\n\n\n
                  • Engage in fraudulent, illegal, or deceptive activities.
                    Violation of these rules may lead to immediate account suspension or termination.<\/li>\n<\/ul>\n\n\n\n

                    11. Intellectual Property<\/h2>\n\n\n\n

                    All content, design, trademarks, and software used on the Platform are owned by Buy & Stamp or its licensors. You may not copy, distribute, or reproduce any part of the Platform without prior written consent.<\/p>\n\n\n\n

                    12. Limitation of Liability<\/h2>\n\n\n\n
                      \n
                    • Buy & Stamp provides the Platform \u201cas is\u201d and does not guarantee uninterrupted or error-free service.<\/li>\n\n\n\n
                    • We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform or transactions with Merchants.<\/li>\n\n\n\n
                    • Our total liability, in any case, shall not exceed the total fees paid by you to Buy & Stamp in the preceding three (3) months.<\/li>\n<\/ul>\n\n\n\n

                      13. Amendments<\/h2>\n\n\n\n

                      We may update these Terms at any time. Continued use of the Platform after such updates constitutes your acceptance of the revised Terms. The latest version will always be available on our website.<\/p>\n\n\n\n

                      14. Governing Law and Dispute Resolution<\/h2>\n\n\n\n

                      These Terms shall be governed by and construed under the laws of Nepal<\/strong>.
